Welcome to Rising Tide MoCo MMA ("Academy," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our martial arts training services, facilities, website (mocomartialarts.com), and any related services we provide. By enrolling in classes, visiting our facility, using our website, or otherwise engaging with our services, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree to these Terms, you may not use our services or facilities.
By registering for classes, attending our facility, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf.
Rising Tide MoCo MMA provides martial arts instruction and fitness training services to individuals of all ages and skill levels. Our services include, but are not limited to:
Class schedules, instructors, and program offerings are subject to change at our discretion. We reserve the right to modify, suspend, or discontinue any service or class at any time without prior notice.

By participating in our programs, you acknowledge and accept these risks. You agree to assume full responsibility for any injuries, damages, or losses you may sustain while using our facilities or participating in our programs, whether caused by the negligence of Rising Tide MoCo MMA, its instructors, employees, other participants, or otherwise.
You voluntarily waive any and all claims, demands, or causes of action against Rising Tide MoCo MMA, its owners, instructors, employees, agents, and affiliates arising out of your participation in our programs or use of our facilities, including claims for personal injury, property damage, wrongful death, or any other loss.
This waiver applies to all claims, whether based on negligence, breach of contract, or any other legal theory, and includes claims arising from the use or condition of facilities, equipment, instruction, or supervision.
We offer various membership plans, including monthly memberships, class packages, and drop-in rates. Membership fees, payment schedules, and billing terms will be provided at the time of enrollment.
If a payment fails or is returned for insufficient funds, you remain responsible for the outstanding balance. We may charge a late fee or suspend your membership privileges until payment is received. Continued non-payment may result in termination of membership and potential collection action.
Membership cancellations must be submitted in writing (email to info@mocomartialarts.com) at least 30 days before your next billing date. Cancellations received after the billing date will not be refunded, and you will remain responsible for that month's fees. Class packages and prepaid programs are non-refundable.
We offer free trial classes to prospective members. Trial class participants must:
Free trial offers are limited to one per person and may not be combined with other promotions. We reserve the right to deny trial class participation at our discretion.
We reserve the right to cancel, reschedule, or substitute classes or instructors at any time due to instructor availability, facility maintenance, inclement weather, or other circumstances. We will make reasonable efforts to notify members of schedule changes via email, text message, or posted notice. No refunds or credits will be issued for cancelled classes.
All members, guests, and visitors are expected to conduct themselves in a respectful, safe, and professional manner. The following behavior is prohibited:
Violation of our Code of Conduct may result in immediate termination of membership without refund and a permanent ban from our facilities.
Participants under 18 years of age must have a parent or legal guardian complete all registration forms, waivers, and agreements on their behalf. Parents/guardians agree to assume all risks on behalf of the minor and agree to supervise minors before and after classes.
By enrolling a minor, you represent that you are the legal parent or guardian with authority to consent to the minor's participation. You agree to indemnify and hold Rising Tide MoCo MMA harmless from any claims arising from the minor's participation.

Rising Tide MoCo MMA is not a medical provider. Our instructors are not licensed medical professionals. Any advice, guidance, or instruction provided is for educational and training purposes only and does not constitute medical advice. Always consult a licensed physician before beginning any new exercise or training program.

Message frequency may vary. You may receive up to 4 messages per month. During periods of high activity (e.g., promotional events, schedule changes), message frequency may increase.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services, you agree to first attempt to resolve the dispute informally by contacting us at info@mocomartialarts.com. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through binding arbitration in Montgomery County, Maryland, in accordance with the rules of the American Arbitration Association.
You agree to waive any right to a jury trial or to participate in a class action lawsuit.
We reserve the right to modify, amend, or update these Terms at any time. Changes will be effective immediately upon posting to our website (mocomartialarts.com/terms.html) or notification via email or text message. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
